Spanish Lawyer Clarifies Disability Pension Rules: 5 Years of Contributions May Be Enough

New Clarity on Disability Pension Requirements in Spain Madrid, Spain – A recent online video by lawyer Víctor Arpa has shed light on the often-misunderstood requirements for obtaining a permanent disability pension in Spain, offering crucial information that could benefit many potential applicants. The video, which has garnered significant attention, clarifies that the common belief of needing 15 years of contributions is not always accurate. According to Arpa, individuals over 31 years old may qualify for a permanent disability pension with substantially fewer years of contributions than generally thought. "Many people confuse this with retirement," Arpa stated in the video, "but it's not the same." He explained that the general rule requires contributions for at least one-quarter of the time that has passed since the applicant turned 20, up until the date of application. For instance, a 40-year-old would need 5 years of contributions (one-quarter of the 20 years between ages 20 and 40). Additionally, at least one year of these contributions must fall within the last decade before the application. The lawyer also highlighted a critical distinction for cases involving work accidents. "If it's a work accident, there is no contribution requirement," Arpa emphasized, suggesting that even those with very limited contribution periods could be eligible under these circumstances. The video has resonated with the public, as evidenced by numerous comments seeking further clarification and sharing personal experiences. One user asked, "Can I apply for a disability while working? Or do I necessarily have to be on sick leave?" Another expressed frustration, "I have three herniated discs and am awaiting surgery, but they denied my disability and discharged me." These comments underscore a widespread need for accessible and clear information regarding disability benefits. While the video focuses on Spanish law, its core message about understanding specific eligibility criteria could encourage individuals in other regions to investigate their local regulations more thoroughly. The information provided by Abogado Víctor Arpa aims to empower citizens to pursue their rights for permanent disability pensions, even if they believe they do not meet the standard contribution periods.
