Moldovan MP Fights for Transparency in Constitutional Court Judge Selection
Moldovan MP Proposes Reforms to Enhance Transparency and Depoliticize Constitutional Court Moldova is facing an upcoming change in the composition of its Constitutional Court, with the mandates of five out of six judges expiring soon. This has prompted independent MP Olesea Stamate to introduce a series of amendments to the law governing the court's operations. Her primary goal is to depoliticize the judge selection process and ensure greater transparency. "The current legislation limits itself to the process of dividing the powers of appointment between Parliament, the Government, and the Superior Council of Magistracy, without establishing a clear selection procedure," Stamate explained in a recent press conference. She highlighted concerns about the lack of transparency and the potential for political interference in the appointments. Stamate's proposed amendments aim to address these concerns by introducing a clear mechanism for selecting candidates. This includes a public selection process involving the analysis of candidates' files and public interviews. The decision to select candidates would be accompanied by a transparent explanation of the reasoning behind the choice. Furthermore, she advocates for a qualified majority in the Parliament to ensure that appointments are not influenced by the party holding the parliamentary majority. "This amendment is justified by the need to avoid politicization and the appointment of judges by parties holding a parliamentary majority," Stamate stated. The video concludes with Stamate urging citizens and fellow MPs to support her proposed changes, emphasizing that their implementation will contribute to the depoliticization of the appointment process, strengthening the integrity of the Constitutional Court, and increasing public trust in the institution.
