
Galician Court Hears Appeal in Homicide by Omission Case
A Coruña, Spain – The Superior Court of Justice of Galicia (TSXG) is hearing the appeal of a man convicted of homicide by omission in the death of his partner, Nerea Añel. Julio, the convicted man, is appealing his 10-year sentence. His lawyer, arguing before the TSXG, claims there is insufficient evidence to prove Julio was present when Nerea died or that he had a legal obligation to assist her. "There is a defect in the assessment of the evidence," explains Jorge Temes, lawyer for the private prosecution, summarizing the defense's argument. "It doesn't result from the evidence that Julio was there. And it is also considered that he did not have the obligation, in the event that he was there, to assist her, because they were not a couple." However, the prosecution maintains that the evidence, including Julio's initial statement acknowledging the relationship, supports the conviction. The TSXG will now decide whether to uphold the 10-year sentence.
