
De Lima Acquittal Overturned: Legal Battle Continues
Former Philippine Senator Leila de Lima will not be returning to prison, according to a recent Court of Appeals decision. The CA overturned a lower court's ruling that found de Lima guilty of drug trafficking charges. The Justice Department spokesperson, Asec. Mico Clavano, confirmed that the CA's decision will not lead to de Lima's re-incarceration. However, this decision has been met with criticism. Retired Supreme Court Associate Justice Antonio Carpio stated that the CA's decision was incorrect, citing a failure to comply with the constitution. De Lima's lawyer, Attorney Balintanghali Kay, maintains that the acquittal was justified. The case has now been remanded back to the Muntinlupa RTC, where the Department of Justice prosecutors will continue to represent the People of the Philippines. Comelec Chairman George Garcia stated there is no reason to suspend de Lima's proclamation as a party-list representative.
