Lorente clarifies that employers in Spain cannot unilaterally decrease an employee's wages without fulfilling specific legal requirements. According to the lawyer, a salary modification is considered a "substantial modification" of working conditions. For such a change to be legally permissible, employers must demonstrate clear economic, technical, organizational, or productive reasons. Additionally, the employer is legally obligated to notify the affected employee with a minimum of 15 days' advance notice before implementing any salary reduction. Lorente advises employees who believe their salary reduction is not backed by the aforementioned legitimate reasons that they have a right to challenge the decision. He states that employees are granted a 20-working-day period to file a claim if they deem the salary reduction unjustified. This information is crucial for workers to understand their rights and the legal framework protecting their wages.
