In a recent online explanation, Buendía clarified the multifaceted nature of coliving, defining it as an arrangement where individuals rent a room alongside a package of shared services, including cleaning, coworking facilities, utilities, and internet access, all designed to foster community and a shared lifestyle. Buendía highlighted a significant challenge facing this emerging trend: "The problem is that it is not specifically regulated, so everything will depend on the contract." This lack of explicit legislation means coliving agreements must currently be categorized under existing rental laws, which can lead to varying rights and obligations for tenants. The notary detailed four potential legal classifications for coliving contracts in Spain. Depending on the specifics of the agreement, it could be considered: 1. Tourist rental: Subject to specific tourism regulations. 2. Seasonal rental: Governed by the Urban Leases Law (LAU) for uses other than habitual dwelling. 3. Room rental: Primarily subject to the Civil Code. 4. Habitual dwelling rental: Also subject to the LAU, offering the most extensive tenant protections.
