Madrid, Spain – A prominent labor lawyer, Juanma Lorente, has issued a crucial warning to employees across Spain, urging them to secure written proof of their approved vacation periods to avoid potential dismissal. In a recent online video, Lorente highlighted a common loophole in many companies' administrative practices, where a lack of formal vacation records could be used as grounds for an employee's dismissal. "Many companies do not maintain a written record of who is on vacation and for how long," Lorente explained. "This poses a significant risk because if an employee is absent for three days without documented proof of leave, the company can legally dismiss them for absenteeism, and crucially, without any severance pay." He cited instances where employees, genuinely on vacation, have faced such unjust dismissals due to insufficient documentation. "It's a simple step that can prevent a major headache," Lorente emphasized. "Always ensure you have a written confirmation – an email, a signed document, or even a WhatsApp message from your employer – proving your approved time off. It costs nothing and provides essential legal protection." Experts suggest that while many employers operate in good faith, employees should proactively protect their rights, especially in an increasingly digital and often informal communication landscape. The advice serves as a timely reminder for workers to be vigilant about their employment documentation.
